Terms of Service Agreement
This service allows you or people you authorize to initiate a funds transfer (“ACH transfer”) between your accounts at the Credit Union of Colorado, an FCU (Credit Union) and/or an account you control at another financial institution located within the United States. International transfers are not supported by this service.
By clicking the “Transfer” button and using the Credit Union’s ACH transfer service, you agree to the terms and conditions of this agreement. You authorize the Credit Union as the Originating Depository Financial Institution (“ODFI”) (as defined under NACHA rules) to originate ACH credit/debit entries to your account(s) as instructed. If this is a recurring ACH transfer, this authorization remains in full force and effect until the Credit Union has received notification from you of its termination in such a manner as to afford the Credit Union a reasonable opportunity to act on it (no less than 3 business days prior to the next scheduled transfer date).
You represent that you are at least eighteen (18) years old and a resident of the United States. Additionally, you represent that you are the owner or an authorized agent of the applicable accounts and have the right to access, use, and authorize us to initiate ACH entries to debit or credit such accounts in the amount you have specified.
You understand that the Credit Union may originate more than one ACH entry to accomplish the transfer you are requesting or authorizing. These ACH entries may be originated and/or posted to your account in any sequence. You authorize us to resubmit debit entries against your account as needed to fulfill the ACH transfer you have requested.
The Credit Union will process your funds transfer request based on the information you or person(s) you authorize provides. Any errors in the information (including incorrect or inconsistent account names, account numbers or ABA routing numbers) that you provide to us are your responsibility. The Credit Union is not responsible for investigating such discrepancies and may execute an ACH transfer using account number information only, even if the name and the account number do not match.
You agree to use a browser or mobile applications that meets our minimum system requirement standards.
If your account(s) at the Credit Union or another financial institution has a joint account holder, you represent and warrant that each joint account holder has consented to the ACH transfer(s) whether sending or receiving funds.
If you are using an account at another financial institution, we will offer two ways to verify your control of the non-Credit Union account. For verification purposes, you authorize us to request online credentials for the other financial institution through a third-party provider or make small deposits and/or withdrawals to the target account (and to reverse these after the test is completed). For the deposit and withdrawal verification process, the withdrawal amount(s) will never be greater than the deposit amount(s). You agree to verify online the amounts of such deposits and/or withdrawals. We will not complete any funds transfer requests until verification is completed.
The Credit Union, in our sole and absolute discretion, have the right to reject, reverse, or cancel any ACH transfer you initiate, and/or restrict or condition your ability to use this or any other service, at any time for any reason or no reason, including but not limited to insufficient funds in an account being debited; suspicious activity; order of any law enforcement agency or other legal process; inability to verify information you or others provide or are asked to provide; providing us with false or inaccurate information; hacking, tampering or impacting the service functionality, availability, or security; using the service for unlawful purposes (as determined by us in good faith, but without the need for inquiry); failing to cooperate with any information request; or any other situation where the Credit Union determines in good faith and at our sole discretion there is an unacceptable risk of loss to you or the Credit Union.
You agree to comply with the National Automated Clearing House Association (“NACHA”) rules. You acknowledge that our origination of ACH entries under this agreement must comply with United States law. You agree to use the service for legal purposes only and not in violation of any U.S. or foreign laws, including but not limited to laws and regulations designed to prevent money laundering or the transfer of funds to or from persons or organizations whose accounts are blocked under regulations promulgated by the U.S. Treasury Department, such as sanction laws administered by the Office of Foreign Asset Control. You agree that if we suspect or believe a transaction is unlawful or even suspicious, we may block the transaction and take any other action we deem to be reasonable. This includes acting to prevent violations of the Unlawful Internet Gambling Enforcement Act of 2006 (“UIGEA”) and these Terms of Service. You agree not to use the service in any manner that could damage, disable, overburden, or impair the service or interfere with any other parties use of the service.
All items or Automatic Clearing House ("ACH") transfers to your account(s) are provisional and subject to return or reversal. If the Credit Union receives returns or reversals or if we must otherwise reverse an ACH transfer for any other reason including not receiving final payment, we reserve the right to charge your account for the amount of those items or ACH transfers and impose a $25 return charge to your account. After we have received final payment, we refer to these deposits as collected items. If the Credit Union incurs any fee(s) to collect any item, the Credit Union may charge such fees to your account. The Credit Union reserves the right to delay, refuse, or to return all or any items or funds transferred.
On most transfers you should expect to see the funds in the destination account within 1-2 business days depending upon the time the transfer was initiated and processed. However, specific transaction times may vary, and the Credit Union does not guarantee any specific turnaround time to complete your funds transfer. If there is a problem with executing your request, we will notify you by the email address on record. When a transfer is initiated from a Credit Union account, please make sure you have sufficient funds to cover the transaction amount. Otherwise if the transaction fails or results in a negative balance in the Credit Union source account, a $25 non-sufficient funds fee may be charged.
In consideration of the agreement by the Credit Union to act upon your request to transfer funds in the manner provided for in these terms and conditions:
- If any fees, fines or other sanctions, or damages or loss, are incurred or suffered by us in connection with your use of the ACH transfer service, you agree to indemnify, defend, and hold us harmless.
- The ACH transfer service, information, data, features and web-based content are offered and made available on an “as is”, “as available” basis. In no event shall we be liable to you (and if you are a non-consumer, your company, employees, agents, third parties, associates, or partners), or to anyone else for any consequential, incidental, special, punitive, or indirect damages of any kind whatsoever, including without limitation those resulting from loss or impairment of use, data, or profits, that you or anyone else may incur relating to your use or access to this site, or the use or access hereto by anyone else, even if we have been advised of the possibility of any such damages.
- You expressly waive any and all claims you may have or assert against us relating directly or indirectly to accessing or using or reliance upon any such information or data by you or anyone else.
- The term “damages” as used herein includes, without limitation, any and all liability, loss, damage, injury, claim, founded or unfounded, expense, fee of any kind, including, attorneys’ or accountants’ fees.
- If you are a consumer, the foregoing is limited to the extent that it may conflict with any non-waivable rights you may have under applicable law.
